If you get laid off while abroad, your H1B ends immediately and you probably can’t reenter. The 60-day grace period only applies if you're still in the U.S. when laid off. Reentering on a tourist visa is risky and not guaranteed.
Talk to a lawyer ASAP—this can get messy fast.
If you’re laid off while outside the U.S. on an H1B, you technically lose your status immediately and may be denied reentry, even just to wrap things up. CBP could turn you away if they see you no longer have a valid job tied to your visa.
That said, some people do reenter without issues, especially if the system hasn’t updated your employment status yet. But it’s risky—depends on the timing and the officer at the border.
If you're really close to leaving, talk to an immigration lawyer ASAP. In some cases, entering on a tourist visa (B2) after an H1B layoff is possible for personal matters, but that also comes with risks.
TL;DR: There’s a real chance you get stuck outside. Proceed with caution and get legal advice fast.
def not legal advice, but from what I’ve seen: reentry after layoff = high risk, no guarantee. your best bet is trying to avoid getting laid off while abroad in the first place 😬
I’d also check w/ an immigration lawyer ASAP. sometimes timing, SEVIS updates, and how your termination is processed can make a difference
alternatives (none of them great):
– have someone you trust pack your stuff + sublease/break the lease
– try to get written confirmation you’re still employed before flying
– see if company will delay the termination date so you can reenter legally
ok so I booked a trip to Mexico, leaving soon. expensive, can’t cancel. but now I’m hearing layoffs might happen while I’m gone. I’m on an H1B. if I do get laid off while I’m outside the US, can I still fly back to grab my stuff, end my lease, and leave properly? or am I gonna be stuck outside with zero closure?
