Position Summary


The Associate Litigation Attorney, MVA will assist with MVA accounts in a litigation status. Litigation status includes, but is not limited to, representing hospital clients in lawsuits to enforce liens (and the entire process until the conclusion of the case, including discovery, motions, etc.), responding to motions to quash liens on behalf of all hospital clients, and responding to interpleaders on behalf of hospital clients. The Associate Litigation Attorney, MVA will work with the Litigation attorney to serve as an additional contact for reductions and settlement negotiations regarding resolution of outstanding motor vehicle accidents and third-party liability accounts, for specific Georgia clients. The Associate Litigation Attorney, MVA will work diligently to advocate for the highest possible reimbursement.


Key Responsibilities
  • Responsible for a portfolio of litigation cases from start to finish as determined by the Litigation Attorney and/or Senior Attorney, MVA.
  • Assist with the representation of hospital clients in state and civil courts.
  • Draft pleadings, motions, briefs, and other legal documents for assigned caseload. • Conduct hearings, trials, and mediations as needed.
  • Advocate for assigned clients' interests and rights effectively in court and in negotiations. • Ensure compliance with legal ethics and professional standards.
  • Uphold confidentiality of client information and maintain ethical practices in all aspects of legal representation.
  • Responsible for reduction requests, settlement negotiations, and fulfillment of payment for specific Georgia clients, as determined by the Litigation Attorney and/or the Senior Attorney, MVA.
  • Conduct timely and thorough telephone follow-up with Attorney offices to ensure timely resolution.
  • Partner with the attorney team to develop strategies to resolve claims favorably and cost-effectively for clients.
  • Communicate effectively with internal & external clients to understand needs and objectives.
  • May serve as an escalation point for accounts that will be litigated and work with the Litigation Attorney to make a determination on whether to file a lawsuit to enforce the lien, send a demand to the liability carrier, or return the account to the client, in the best interest of client.
  • Partners with Senior Attorney, Litigation Attorney, and legal assistant/paralegal to complete and resolve shared tasks and goals, including but not limited to, decisions to move forward with lien enforcement.
  • Other duties as required.


Requirements & Qualifications
  • Juris Doctor (J.D.) from an accredited law school.
  • Active License to practice law in Georgia.
  • At least 6 months experience with Workers compensation claims, personal injury claims, or general litigation.
  • 1 year in healthcare field in billing or collections or workers compensation/personal injury, preferred.
  • Strong litigation and courtroom experience, including trials and hearings.
  • Excellent analytical, problem-solving, communication, and negotiation skills.
  • Basic experience working with a team of attorneys
  • Strong problem-solving and decision-making abilities.
  • Strong analytical, negotiation, and communication skills.
  • Must have strong computer proficiency and understand how to use basic office applications, including MS Office (Word, Excel, and Outlook).
  • Regular and predictable attendance.
