Primary Job Duties and Responsibilities (Essential Job Function)
The international tax manager provides direction and management for the international income tax function of Berkshire Hathaway Energy and subsidiaries in a manner that ensures accurate and timely reporting of all income, credits and other items related to foreign operations in all federal, state and local income tax, withholding tax and information returns. The international tax manager also ensures accurate and timely reporting of all foreign, provincial and other local income tax, withholding tax and non-income tax returns. This position is also responsible for United States and foreign tax related computations and disclosures in the monthly, quarterly and annual financial statements. This position will manage all foreign jurisdiction tax issues and will assist with merger and acquisition activity that involve foreign jurisdictions. The international tax manager will assist with the training and mentoring of international tax staff.
Typical Duties
Provide timely and accurate support to the director, international tax and tax planning to ensure compliance with US and foreign tax law and to ensure that all internal and external deadlines are met. (40-50%)
Manage the international tax function for Berkshire Hathaway Energy Company and subsidiaries. (40-50%)
Manage the process of compliance with all income tax and non-income tax laws in all foreign jurisdictions in which Berkshire Hathaway Energy Company conducts business. Assist with the preparation and review of the federal sub-consolidated income tax return for Berkshire Hathaway Energy Company and subsidiaries with respect to the reporting and documentation of all items related to foreign operations, including computation of earnings and profits under US tax rules for every foreign subsidiary, computation of foreign source income subject to current US taxation, computation of the foreign tax credit limitation, computation of foreign tax credits and completion of all information returns such as Forms 5471, 8865, 8858, etc. (40%)
Assist with the preparation and review of all U.S. federal and state corporate income tax returns for all non-consolidated, foreign owned U.S. subsidiaries. (10%)
Assist with the review, and possibly the preparation, of Canadian and provincial corporate and partnership income tax returns. (0-5%)
Manage the preparation of all quarterly computations of taxable foreign source income for purposes of U.S., state, local, Canadian and provincial quarterly estimated tax payments. (0-5%)
Manage the preparation of transfer pricing documentation for all cross-border transactions in all jurisdictions to ensure timely compliance with requirements in all jurisdictions. (0-5%)
Monitor the Organization for Economic Cooperation and Development (OECD) base erosion and profit shifting (BEPS) project and ensure accurate and timely compliance with all related legislation and expanded reporting requirements. (0-5%)
Manage the preparation of monthly, quarterly and annual income tax provision computations and disclosures related to US and foreign taxation of income from foreign operations. (15%)
Manage the U.S. reporting, record keeping and withholding requirements with respect to all payments to all foreign persons and entities by any domestic entity owned directly or indirectly by Berkshire Hathaway Energy Company. Ensure compliance with the Foreign Tax Compliance Act (FATCA). Assist with the preparation and review of all related information and withholding tax returns including Forms 1042, 1042T and 1042-S. Monitor and document activities in foreign jurisdictions by US employees for purposes of compliance with foreign payroll withholding requirements and foreign tax return filing requirements. Assist with the preparation and review of foreign tax calculations and foreign withholding tax returns, income tax returns and payroll tax filings related to foreign travel by employees and business activities conducted in foreign jurisdictions. Provide support related to worldwide tax planning, budgeting and forecasting activities. (0-5%)
Monitor, model, document and communicate the impact of U.S. international and foreign tax legislation as it relates to the business activities of Berkshire Hathaway Energy Company and subsidiaries. (0-5%)
Support merger and acquisition activity in foreign jurisdictions. (0-5%)
Research and analyze complex tax issues. (0-5%)
Draft memoranda regarding tax issues and transactions. (0-5%)
Manage compliance with the U.S. Department of Treasury Foreign Bank and Financial account filing and reporting requirements for Berkshire Hathaway Energy Company and subsidiaries. (1%)
Provide technical leadership and mentoring to international tax staff. (0-5%)
Perform additional responsibilities as requested or assigned. (0-5%)
Requires a bachelor's degree in accounting with a graduate degree in accounting, tax or certified public accounting designation, or a law degree with an LLM.
Minimum of eight to ten years of related work experience, six of which is in international tax.
Solid federal and international income tax compliance experience is required including consolidated return experience and extensive knowledge of foreign tax laws.
Additional experience is required in the areas of mergers and acquisition, dissolutions and forecasting.
Requires extensive tax research skills.
Working knowledge of tax systems (e.g., Oracle and CorpTax) with extensive computer skills with Excel, Word and PowerPoint.
Strong regulatory and income tax accounting experience is required.
Strong leadership and mentoring skills with the ability to communicate complex concepts to senior management as well as tax associates.
Requires effective written and oral communication skills (including presentation skills),
Requires project management skills; including the ability to prioritize and handle multiple tasks and projects concurrently, and effective analytical, problem-solving and decision-making skills.
