Position Summary:

Capital Rx is looking for a dynamic and experienced Legal Counsel/Senior Legal Counsel, reporting directly to the General Counsel, to provide strategic legal advice to internal business partners with respect to healthcare regulations and laws. The successful candidate will identify legal and business risks and solutions that balance legal risks and business objectives. You will be expected to develop a keen understanding of the business and operational goals of Capital Rx and you will be expected to develop and maintain positive relationships with clients at all levels of the organization, and provide practical and sound advice on legal issues related to business objectives and take an active role in driving projects to a result.

Position Responsibilities:

  • Work collaboratively with business partners, including operations, pricing, client management teams/sales and compliance, and other attorneys on a wide variety of matters, including contracts and legal and regulatory compliance to provide quality, solution-oriented legal advice in a dynamic business and legal environment.
  • Advising internal clients with respect to the application of federal and state laws and regulations to Capital Rx’s operations.
  • Review, draft and negotiate Capital Rx contracts with PBM/PBA clients and supporting client account teams/sales activities. An emphasis relating to the Company’s multiple lines of business including but not limited to Pharmacy Benefits Management (PBM) Agreements, with third party payors.
  • Supporting Capital Rx’s activities, including strategy, sales support, pre-litigation dispute resolution, and various other legal and regulatory research and analysis projects or presentations.
  • Providing legal expertise on company-wide initiatives, which may require legal research and advice related to various parts of the Capital Rx’s activities.

Required Qualifications:

  • 7+ years legal attorney experience in a law firm and/or in-house setting.
  • In depth knowledge of healthcare laws, regulations and industry standards governing the provision of healthcare.
  • Admitted to practice law in at least one state and in good standing of applicable bar association.
  • Healthcare laws and regulations including: HIPAA, Medicare, Medicaid, False Claims Act, or Federal Anti-Kickback Statute.
  • Excellent written and oral communication skills in a professional manner.
  • Experience working with PBMs and related laws.
  • Proven ability to thrive in a fast-paced, performance-driven culture.
  • Demonstrated leadership initiative, resilience and ability to embrace change.
  • Strong work ethic, be a self-starter, and able to be highly productive in a dynamic, collaborative environment.

Base Salary: $120,000 - $250,000

This range represents the low and high end of the anticipated base salary range for the NY - based position. The actual base salary will depend on several factors such as: experience, knowledge, and skills, and if the location of the job changes.
