Major position responsibilities include the following:
- Analyze a wide array of legal issues, including but not limited to wage and hour, employment discrimination, professional liability, and commercial disputes
- Manage responses to complaints, claims, subpoenas, and charges against Triage or its agents
- Advise senior leadership of legal risks to the business and recommend solutions to mitigate risk
- Proactively develop policies and procedures to mitigate legal risk
- Provide legal guidance on the company’s employment handbooks on an annual basis, or as needed when internal policies or external regulations change
- Provide advice and counsel to internal team members to proactively address and resolve current and potential disputes
- Engage external counsel to resolve complex legal issues, and coordinate all correspondence with outside counsel
- Manage all business contracts, including client, vendor, and employee contracts
- Maintain current knowledge of changing laws and regulations, particularly in the areas of employment, healthcare, staffing, data security, and privacy
- Communicate and negotiate with external parties, including but not limited to regulators, external counsel, public authorities, healthcare facilities, and vendors
- Manage requests for depositions and legal interviews of Triage’s internal employees and traveling healthcare professionals
- Conduct internal investigations and collaborate with healthcare facilities to investigate issues involving traveling healthcare professionals
- Manage immigration issues, including visa sponsorship
Requirements
- Must have J.D. from an ABA-approved law school
- Must have an active license to practice law in the state of Nebraska
- Must have 5 years of legal experience or more
- Preference for a combination of experience at a law firm and in a corporate setting
- Experience with federal and multi-state employment law is required; experience in healthcare is preferred
- Must have thorough knowledge of employment laws, including but not limited to Title VII of the Civil Rights Act, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Nebraska Fair Employment Practices Act, the Family Medical Leave Act, the Uniformed Servicemen Employment and Reemployment Act, the Employee Retirement Income Security Act, the Health Insurance Portability and Accountability Act, the Occupational Safety and Health Act, the National Labor Relations Act, and the Fair Labor Standards Act
- Must have knowledge of laws, regulations, and best practices related to employee compensation, including wage and hour laws, pay equity, sales commissions and incentives, non-compete agreements, restrictive covenants, and employment agreements
- Must have knowledge of employment-based immigration
- Must have successful track record of preventing and defending EEOC claims, wage and hour claims, and other employment-related claims
- Must have strong organizational, analytical, communication, negotiation, and writing skills
- Must display a strong sense of urgency to meet all deadlines
- Must continuously advocate for Triage and positively represent the company when interacting with internal and external constituents
