Job Overview

We are seeking an experienced Marketing Compliance Lawyer with at least four years of experience in marketing and advertising law. This role will focus on managing the compliance program for HighLevel’s network of social influencers. The ideal candidate will be a strategic advisor, partnering with our affiliate marketing and legal teams to proactively mitigate risks and support compliant, creative, and effective marketing initiatives.

  • Excellent communicator; ability to clearly articulate risk exposures and simple solutions in a fast-paced, product-driven environment
  • Experience presenting and training large audiences on marketing and advertising rules
  • Strong leadership skills, work ethic, and excellent judgment
  • A good sense of humor and a passion for helping the business succeed


What You Will Do
  • Legal Review of Marketing Campaigns: Conduct comprehensive legal reviews of marketing materials, advertising campaigns, and promotional content to ensure compliance with relevant laws, such as the FTC Act, CAN-SPAM Act, GDPR, and COPPA.
  • Social Media and Digital Advertising Compliance: Advise on social media policies, influencer agreements, and digital marketing practices, ensuring adherence to guidelines on endorsements, disclosures, and data usage.
  • Consumer Protection and Claims Substantiation: Evaluate advertising claims, disclosures, and marketing materials to ensure compliance with consumer protection laws, including truth-in-advertising requirements and claims substantiation.
  • Cross-functional Collaboration: Partner with marketing, product, and compliance teams to implement marketing campaigns that align with legal standards while achieving business objectives.
  • Contract Drafting and Negotiation: Draft, review, and negotiate marketing-related agreements, including sponsorship, influencer, and endorsement contracts, as well as co-branding and licensing agreements.
  • Data Privacy in Marketing: Ensure compliance with data privacy regulations in marketing practices, including consent management, data collection, and use, particularly for targeted advertising and digital tracking.
  • Policy Development and Training: Develop, update, and communicate internal policies regarding advertising, marketing practices, and social media use. Conduct training for marketing teams on compliance matters.
  • Regulatory Monitoring and Reporting: Stay up-to-date on relevant legal trends and regulatory changes affecting marketing and advertising practices, and advise the organization on required adjustments.


What You Bring
  • Education: JD degree from an accredited law school; active license to practice law in [relevant jurisdiction].
  • Experience: Minimum of 4 years of experience in marketing and advertising law, ideally within a corporate or in-house legal setting or a law firm.
  • Knowledge: Strong knowledge of laws and regulations governing marketing and advertising, including intellectual property, consumer protection, and digital advertising.
Skills:
  • Excellent written and verbal communication skills, with the ability to explain complex legal issues to non-legal stakeholders.
  • Proven ability to develop practical, business-oriented solutions to complex legal challenges.
  • Strong attention to detail and ability to manage multiple projects simultaneously.
  • Experience working in a fast-paced environment and supporting cross-functional teams.
  • Familiarity with data privacy laws and their impact on marketing practices is a plus.
