Then this State Liability Prevention Specialist position with the Division of Risk Management is just for you!Primary Duties:As a State Liability Prevention Specialist, specifically for HR Risk Mitigation, you will:• Provide consultation, training, and recommendations in the areas of employment, Title VII, and compliance with the American with Disabilities Act.• Provide training and support to state agencies, higher education, and K-12 on employment, Title IX, and ADA.• Investigates and formulates strategies to avoid lawsuits against the state or other Risk Management clients.• Recommends changes to existing, policies and procedures, laws or regulations.• Analyzes, summarizes, and reviews data; reports findings, interprets results and/or makes recommendations.State Liability Prevention Specialists work in the Division of Risk Management and function as a lead or senior technical expert in reducing liability to the Risk Management Fund. This position carries no prescriptive authority; the candidate helps customers make changes through training, cooperation, and persuasion. Specialists consult with and provide training to insureds'; management and staff regarding applicable state and federal laws, policies, and procedures; identify compensable liability associated with state government, public school and/or college/university operations; recommend ways to reduce liability; and develop and present training.Minumum Qualifications:• The ideal candidate will have over ten years of experience consulting with legal and HR professionals in identifying and preventing complex employment law and civil rights exposures.• The ideal candidate will also be an effective communicator both in written and oral contexts, a competent researcher, and experienced with Microsoft Word and PowerPoint.• Experience with and knowledge of applicable laws, rules, regulations and/or policies and procedures concerning state and federal employment and civil rights liability prevention, including, but not limited to: UPPEA, ADA, FMLA, ADEA, Title VI,Title VII, and Title IX.Preference:Preference may be given to those with a Juris Doctor and/ or 10 years of experience working with and advising public entities.Why You Should Join Our TeamIn addition to the state's comprehensive and competitive benefits package and healthy work/life balance, working for the Division of Risk Management is rewarding! Among those insureds are all state agencies, all public school districts, all public institutions of higher education, and many public charter schools.The Department of Government Operations provides support to, and enables other state agencies to fulfill their core missions.The individual hired through this recruitment will be expected to consult with representatives and legal counsel of the participating entities of the Risk Management Fund, to prevent liability in state and federal employment and civil rights matters affecting employees and students, including, but not limited to, UPPEA, ADA, FMLA, ADEA, Title VI, Title VII, and Title IX. Additionally, the successful candidate will develop and provide effective, competent webinars and training to small and large audiences to create liability prevention awareness with respect to employment and civil rights matters. The successful candidate will also engage the Litigation Division of the Attorney General’s Office to participate in early intervention consultations with the Risk Management Fund’s participating entities.• use logic to analyze or identify underlying principles, reasons, or facts associated with information or data to draw conclusions• evaluate information against a set of standards• speak concisely and effectively; listen to and understand information and ideas as presented verbally• communicate information and ideas clearly and concisely in writing; read and understand information presented in writing• deliver presentations or training using acceptable methods and techniques• principles, theories, and practices of safety and risk management• applicable laws, rules, regulations, and policies and procedures• read, interpret, and apply laws, rules, regulations, policies, and procedures• perform legal research using case law and appropriate techniques• make a decision or solve a problem by using logic to identify key facts, explore alternatives, and propose quality solutions• instructional methods and techniques• develop curriculum, learning objectives, and course materials• provide consultation and expert advice or testimony• agency and organizational program(s)• assess risk and recommend appropriate restrictions• research methods, techniques, and sources of information• develop and implement new policies/procedures/standards and rules/regulations• Risks found in the typical office setting, which is adequately lighted, heated and ventilated, e.g., safe use of office equipment, avoiding trips and falls, observing fire regulations, etc.• Typically, the employee may sit comfortably to perform the work; however, there may be some walking; standing; bending; carrying light items; driving an automobile, etc. Special physical demands are not required to perform the work.• A valid driver's license is required to drive a motor vehicle on a highway in this state per UCA53-3-202(1)(a).• DHRM rules apply for promotions/transfers.
