Director of Labor Compliance is responsible for managing all aspects of our Labor Compliance contract responsibilities. This pivotal role ensures our compliance with labor laws, prevailing wage requirements, and all state and federal labor regulations. The ideal candidate will have extensive experience in labor compliance management and a deep understanding of related laws and regulations.
Duties & Responsibilities- Ensure compliance with labor laws, prevailing wage requirements, and the requirements specified in client contracts.
- Ensure the company follows all state and federal labor laws in regard to prevailing wage law.
- Assist payroll with prevailing wage rate increases and fringe benefit statements.
- Create Fringe Benefit Statements when required
- Ensure all required documents (DAS 140’s, DAS 142’s, etc) are submitted in a timely manner.
- Oversee the certified payroll team member(s) to ensure timely submission of state and federal certified payroll.
- Manage the uploads by certified payroll by utilizing LCP Certified software and/or DIR state mandated site.
- Oversee the Labor Compliance Analyst(s) to ensure compliance.
- Reviews and verifies payroll records, benefit statements, employer training contributions, and apprenticeship paperwork to determine compliance with applicable rules and regulations.
- Issues requests for missing and revised documentation, and corresponds with the applicable contractor’s staff to ensure compliance.
- Participates in audits, calculates underpayments, fines, and penalties if applicable.
- Investigates complaints of noncompliance with prevailing wage payments, Benefit payments, and apprenticeship violations; takes written or recorded statements to establish facts; compiles reports, records any other pertinent material to complete case file.
- Establishes files reflecting all appropriate documentation
- Work with LCP Tracker software to review and approve certified payroll and payroll documents
- Evaluates contractor’s information on the CSLB website to ensure proper licensing and provision of worker’s compensation insurance coverage for employees in case of injury. Notifies appropriate contacts when contractors are not in compliance.
- Composes letter(s) requesting payments and follows up with third party requestor when sending information.
- Ensure monthly report is submitted to Project Manager or Client Project Manager.
Requirements- 10 years of experience in labor compliance management.
- Extensive understanding of Labor Compliance policies, procedures, and practices
- In depth understanding of the California Labor Code pertaining to Public Works Projects
- Extensive knowledge Federal prevailing wage laws and requirements
- Experience performing audits on certified payroll documents
- Extensive knowledge of Disadvantaged Business Enterprise (DBE) requirements
- Understanding of Equal Employment Opportunity (EEO) laws, Department of Labor requirements (including Davis-Bacon Act)
- Must be detail-oriented
- Experience calculating fines/penalties in regards to audits
- Knowledgeable in Project Labor Agreements (PLA).
- LCP Tracker knowledge
