Intellectual Property and Marketing Counsel

We have offices in San Francisco and San Diego for those who prefer hybrid or office settings. Oura employees in other major cities (like Boston and New York) occasionally gather informally at local co-working locations.

What you will do:

  • Provide support on a broad range of IP matters, including domestic and international trademark, copyright and design clearance, enforcement, transactions, and domains
  • Conduct U.S. and international clearance searches to determine the availability of proposed trademarks, taglines, product names, product designs, and other consumer-facing content
  • Manage trademark prosecution and enforcement matters with U.S. and foreign Intellectual Property offices as well as with third parties
  • Liaise with and supervise outside law firms, vendors, and internal business partners as needed for pending IP matters
  • Draft legal documents, including cease and desist letters and Notices of Opposition
  • Review advertising and promotional materials across all forms of media to monitor for marketing and regulatory issues
  • Conduct risk assessments and advise on claim substantiation requirements, right of publicity clearances, and draft disclosures
  • Structure and review Terms and Conditions for marketing promotions, including domestic and international sweepstakes, contests, and other promotions and incentives
  • Draft and negotiate IP licenses (i.e., music, product placement) and marketing agreements with third parties
  • Assist with third-party market analysis
  • Provide education and proactive counseling to the business to manage risk and enhance IP protection

We would love to have you on our team if you have:

  • J.D. and active member of a state bar in good standing
  • At least 5-7 years of experience in-house or in private practice focusing on intellectual property (including trademarks, copyrights, marketing, and the ability to identify patent issues)
  • Advertising and regulatory experience are a plus but not required
  • Experience providing practical advice on a wide variety of legal issues in a fast-paced environment.
  • A track record of drafting and negotiating agreements with an emphasis on trademarks and copyrights.
  • Excellent written and verbal communication skills.
  • A dedication to client service and attention to detail.
  • Strong presentation skills and an ability to educate others about intellectual property in engaging and impactful ways.
  • A familiarity with protecting consumer brands in the technology space.
  • A passion for branding.
  • Ability to work well as part of a team and independently. Ability to provide concise and practical legal advice to a wide variety of business clients and across a broad range of matters with limited supervision.
  • Strong project management abilities and organizational skills
  • Ability to maintain confidentiality of highly sensitive and confidential material
  • Detail oriented with the ability to manage multiple priorities in a fast-paced, high-performance environment

Oura takes a market-based approach to pay, which may vary depending on your location. US locations are categorized into tiers based on a cost of labor index for that geographic area. While most offers will be closer to the starting range, successful candidates' pay will be determined based on job-related skills, experience, qualifications, work location, internal peer equity, and market conditions. These ranges may be modified in the future.

  • Region 1: $140,000 - $165,000
  • Region 2: $133,000 - $157,000
  • Region 3: $126,000 - $148,500
