Legal at Brex

The Legal team helps the company grow responsibly, advocating for Brex and for the thousands of growing businesses we serve. We provide strategic advice and guidance to all Brex teams, protect Brex, advise on risk, and represent the company externally, negotiating with partners and interacting with regulators. Reimagining the financial system in a highly regulated environment requires creativity and resourcefulness, and we welcome the challenge.

What you’ll do

As Regulatory Counsel at Brex, you will play a critical strategic role in helping the company navigate the complex regulatory landscape at the intersection of financial services and technology. You will lead Brex’s regulatory engagement strategy, including proactive relationship management with key state, federal, and international regulators, oversight of examinations and audits, and responses to formal and informal regulatory inquiries.

You will also drive comprehensive monitoring and analysis of legislative and regulatory developments that impact Brex’s products and operations. In partnership with cross-functional teams, you will manage licensing matters, develop and implement regulatory compliance strategies across multiple jurisdictions, and deliver risk-calibrated legal guidance that advances Brex’s business objectives.

In this role, you will work closely with internal teams, external regulators, legislators, bank partners, and industry groups to ensure Brex remains forward-looking, responsive, and trusted in all aspects of regulatory compliance. By translating complex legal frameworks into actionable strategies, you will enable business growth while upholding the highest standards of legal and regulatory integrity.

Where you’ll work

This role is fully remote; however, you must be based in the Washington, D.C. area due to the nature of the role and its requirements. The position involves regular interaction with federal regulators and policymakers, and proximity to key stakeholders in D.C. is essential.

Responsibilities

  • Lead Brex’s overall regulatory engagement strategy, including developing a forward-looking plan for managing relationships with federal and state regulators and legislators
  • Serve as the primary point of contact for all formal and informal regulatory inquiries, examinations, and investigations, coordinating with internal stakeholders to ensure accurate and strategic responses
  • Build and maintain strong, collaborative relationships with key regulatory agencies and policymakers to support open dialogue and establish Brex as a trusted and responsible fintech leader
  • Develop comprehensive position statements, draft detailed notices, and prepare substantive comment submissions that articulate Brex's perspective on emerging regulatory frameworks, proposed legislation, and industry-wide regulatory developments
  • Provide strategic regulatory advice to legal, compliance, product, and executive teams, helping the business make informed decisions in a rapidly evolving regulatory landscape
  • Represent Brex in industry working groups, trade associations, and policy discussions to help shape the future of financial regulation and advocate for innovation in fintech
  • Develop and maintain systems to monitor legislative and regulatory changes across jurisdictions, providing timely, actionable insights to inform Brex’s regulatory strategy and compliance planning
  • Partner with bank partners and external counsel to align on regulatory requirements and develop coordinated, strategic approaches to compliance and regulatory engagement
  • Translate complex regulatory requirements into clear, actionable risk-based guidance for cross-functional teams, ensuring that regulatory considerations are integrated into the company's strategic planning and are actionable

Requirements

  • J.D. from an accredited law school, with a demonstrated track record of excellence in financial regulatory law. Bar admission and active standing in at least one U.S. state
  • Minimum of 5+ years of legal experience in regulatory affairs, with a specific focus on financial technology, banking, payments, or related highly regulated industries
  • Deep understanding of federal and state regulatory landscapes, including comprehensive knowledge of agencies such as the CFPB, Federal Reserve, OCC, FDIC, state banking regulators, and other relevant financial oversight bodies
  • Demonstrated ability to develop sophisticated regulatory strategies, draft complex legal documents, and communicate effectively with high-level regulators, executive leadership, and cross-functional teams
  • Proven track record of building and maintaining strategic relationships with regulatory agencies, demonstrating diplomatic and persuasive communication skills in complex negotiation environments
  • Advanced analytical skills with the ability to interpret intricate regulatory frameworks, assess potential legal risks, and develop innovative compliance solutions that balance regulatory requirements with business objectives
  • Exceptional written and verbal communication skills, with the capacity to translate complex legal and regulatory concepts into clear, actionable guidance for non-legal stakeholders
  • Demonstrated ability to monitor, analyze, and synthesize rapidly evolving regulatory landscapes, providing strategic insights that support proactive compliance and business development
  • Strong project management skills, with the ability to coordinate multiple regulatory initiatives, track complex regulatory developments, and manage time-sensitive regulatory submissions
  • Ability to effectively communicate and collaborate with diverse teams, including remote and cross-functional groups

Bonus Points

  • Experience in fintech or adjacent innovative financial services sectors is strongly preferred, with a nuanced understanding of emerging regulatory challenges
  • International regulatory experience, with proven expertise in navigating cross-border regulatory complexities, including familiarity with international financial regulations
  • Experience with multi-jurisdictional regulatory challenges in key markets such as Europe, Asia-Pacific, or Latin America is a significant plus

Compensation

The expected salary range for this role is $189,600 - $237,000.
