Role Summary
We are seeking an experienced ITAR/Export Control Manager to ensure compliance with U.S. export control laws, including the International Traffic in Arms Regulations (ITAR), Export Administration Regulations (EAR), and other applicable laws governing the export of defense-related products, technology, and services. The ideal candidate will develop, implement, and manage the company’s export compliance program, oversee licensing and shipping compliance activities, as well as provide training and guidance to internal teams. This role is critical to safeguarding the company’s operations and reputation in the defense industry.
Key Responsibilities
Export Compliance Program Management
Develop and maintain a robust export control and ITAR compliance program.
Create and implement policies and procedures to ensure adherence to ITAR, EAR, and other export/import regulations.
Ensures that all exports, technology transfers, and defense-related transactions comply with ITAR, EAR, and U.S. sanction laws.
Empowered Official
Acts as the legally recognized individual responsible for ITAR compliance within the company, authorized to sign and submit export license applications.
Serves as the primary point of contact with the U.S. Department of State’s Directorate of Defense Trade Controls (DDTC) and other regulatory agencies.
Reviews and approves all export license applications, Technical Assistance Agreements (TAAs), and Manufacturing License Agreements (MLAs).
Provides ITAR-related training and oversees internal audits to ensure company-wide compliance.
Reports violations, implements corrective actions, and coordinates voluntary disclosures if non-compliance occurs.
Licensing and Documentation
Prepare, submit, and manage export licenses and agreements (e.g., Technical Assistance Agreements, Manufacturing License Agreements).
Ensure all defense articles, services, and technical data are properly licensed for export.
Maintain records of all export transactions and license applications in compliance with legal requirements.
Classification of Items and Technology
Work with engineers, R&D teams, and product managers to ensure the correct classification of products, software, and technology under ITAR or EAR.
Assist in determining whether items fall under the U.S. Munitions List (USML) or Commerce Control List (CCL).
Internal Auditing and Risk Management
Conduct regular internal audits of processes, systems, and export transactions to ensure compliance.
Identify and mitigate risks associated with ITAR-related activities and develop corrective actions if violations occur.
Training and Awareness
Conduct regular training sessions for employees, particularly those in engineering, procurement, and international sales, to raise awareness of ITAR regulations.
Develop specific training materials tailored to different departments based on their involvement in controlled activities.
Collaboration with External Authorities and Legal Teams
Work closely with government agencies (e.g., the Directorate of Defense Trade Controls, Bureau of Industry and Security) to stay current on regulation changes and trends.
Collaborate with legal and compliance teams to ensure contracts, exports, and projects align with U.S. regulations.
Deemed Export Compliance
Manage deemed export controls (i.e., release of controlled technology to foreign nationals within the U.S.), ensuring proper screening and documentation of foreign employees or partners.
Sanctions and Embargo Management
Monitor U.S. sanctions and embargoes and ensure the company is not transacting with prohibited individuals, entities, or countries.
Implement screening protocols for international clients, vendors, and suppliers.
Work with supply chain management to ensure vendors and suppliers are compliant with ITAR requirements, especially for sub-contracted work or when sourcing parts internationally.
Export Shipping and Logistics Compliance
Strategic Oversight: Establish and enforce export control procedures for shipping defense articles, technical data, and dual-use goods to ensure compliance with ITAR, EAR, and international trade regulations.
Shipping Coordination: Work with logistics, supply chain, and warehouse teams to ensure proper documentation, classification, and authorization before shipment.
Customs and Export Documentation: Ensure accurate Electronic Export Information (EEI) filings, AESDirect submissions, and compliance with customs regulations.
Restricted Party Screening: Oversee screening of international shipping destinations, freight forwarders, and recipients to prevent unauthorized exports to restricted entities.
Packaging and Handling Requirements: Ensure that controlled items are labeled, stored, and transported per ITAR security requirements to prevent unauthorized access.
Carrier and Freight Forwarder Compliance: Collaborate with third-party logistics providers to ensure they comply with ITAR, EAR, and international trade laws.
Incident Response: Address any shipping-related compliance violations, misclassified shipments, or discrepancies in export documentation.
IT Systems & Cybersecurity Compliance
Collaborate with IT and cybersecurity teams to ensure compliance with ITAR digital data storage, encryption, and access control requirements, preventing unauthorized foreign access to controlled technical data.
Ensure secure data transfers and storage of ITAR-controlled information on internal and cloud-based systems.
Business Development & Sales Support
Provide guidance to Business Development and Sales teams on international transactions, reviewing contracts and proposals to ensure export compliance before engaging with foreign customers or partners.
Assess risks associated with international sales, contracts, and technology transfers.
Continuous Improvement & Industry Engagement
Actively monitor changes in U.S. export control laws and participate in industry forums, conferences, and government compliance workshops to stay ahead of regulatory changes and best practices.
Implement best practices for compliance efficiency and risk mitigation.
Experience, Skills, and Required Qualifications
Bachelor's degree in International Business, Law, Engineering, or a related field (Master’s degree or Juris Doctor is a plus).
5+ years of experience in ITAR and export compliance, preferably in the aerospace, defense, or high-tech sectors.
Experience in developing and managing export compliance programs.
In-depth knowledge of ITAR, EAR, and other U.S. export control laws.
Proven experience in preparing and managing export licenses, agreements, and documentation.
Strong organizational skills and attention to detail.
Excellent communication and training skills, with the ability to work cross-functionally with legal, engineering, and supply chain teams.
Familiarity with compliance software and government licensing portals (e.g., DECCS, SNAP-R, AESDirect, SAP GTS).
Qualified candidate must have the ability to obtain a security clearance. This requires U.S. Citizenship
Preferred Qualifications
Certified U.S. Export Compliance Officer (CUSECO) or other relevant certification.
